Incident Type: Clovis Man Charged With Open Count of Murder In January 2013 Robbery of Victim Joe Garcia

Clovis – April 19, 2013 – On Friday, April 19, 2013, an arrest warrant was completed and served on Mr. Daniel Murrell III for the charge of one Open Count of Murder. The beating of Mr. Joe Garcia was perpetrated by Mr. Murrell during the commission of a violent felony crime of Robbery that had occurred on January 4, 2013 in an alley located just north of the Allsup’s Store at 11th and Mitchell in Clovis. Mr. Murrell has been held in the Curry County Adult Detention Center since his January arrest on charges of Robbery (2-counts), Aggravated Battery (1-Count), Conspiracy to Commit Robbery, Intimidation of a States Witness, Theft of a credit card, Fraudulent use of a Credit Card, Felon in Possession of a Firearm and Tampering with Evidence. The murder arrest warrant was served on Mr. Murrell at the Curry County Adult Detention Center by a member of the 9th Judicial District Major Crimes Unit today, where Mr. Murrell is currently being held on related charges to the Robbery incidents from January on a $50,000 bond. Mr. Murrell is now being held on a No Bond charge of Murder.

On January 7, 2013, an ambulance was sent to a home on Gidding Street in Clovis. Upon their arrival, they found victim Joe Garcia to be unresponsive and not breathing. Mr. Garcia was transported to Plains Regional Medical Center where he died in the Emergency Room. Detectives learned Mr. Garcia had been released from the hospital in Lubbock, Texas on January 5, 2013, where he had been transported following the beating that had occurred on January 4, 2013 during the Robbery.

A subsequent autopsy investigation and review by the Office of the Medical Investigator in Albuquerque, New Mexico resulted in a finding of cause of death of blunt force trauma to the head and the manner of death was ruled homicide.

Based on the findings of the Office of the Medical Investigator, the cause and manner of death was presented to the 9th Judicial District Attorney for review and an Affidavit For Arrest on an Open Count of Murder for Mr. Daniel Murrell III was presented to and approved by a local Curry County Magistrate Judge finding probable cause for the arrest.
